What happens if you don't register your mark
In Russia an unregistered brand belongs not to whoever created it, but to whoever files the application with Rospatent first. Registration takes 6 to 9 months, and priority counts from the filing date — the earlier you file, the less chance someone gets there first.
- A competitor registers it firstThe right to a name goes not to whoever started using it earlier, but to whoever filed the application earlier. If someone beats you to it, you either rebrand everything — signage, packaging, website, social media, contracts — or buy your own name back from them, at their price.1
- A marketplace takes your listings downA rights holder only has to file a complaint, and the listings are blocked pending review. The goods sit in the warehouse, the money sits in stock, and the review takes weeks.2
- You end up paying someone else's rights holderFor using someone else's trademark a Russian court awards compensation of 10,000 to 10,000,000 rubles. "I didn't know the name was taken" is not accepted as a defence: the register was open to check before you started.3
